These terms and conditions do not affect your statutory rights. To order goods through the Imagine Living website you must be at least 18 years of age and accept delivery within the UK. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions. These terms and conditions apply to the use of this website and by accessing this website and/or placing an order you agree to be bound by the terms and conditions set out below.

"Conditions" means these terms and conditions; "Product" means a product displayed for sale on the website; "Product Details" means that part of the Website where certain terms and conditions in respect of the individual Product are provided; "Members" means the users of the website collectively; "Personal Information" means the details provided by you upon registration; "We/us" means Imagine Living; "Website" means the website located at www.imagine-living.com or any subsequent URL which may replace it; "Cookies" means small text files which our website places on your computer's hard drive to store information about your shopping session and to identify your computer; "United Kingdom" means England, Wales, Scotland, Northern Ireland and the Channel Islands and "You/Member" means a user of this website. “Manufacturers” means our suppliers of furniture and accessories.
Use of the website
You are provided with access to this website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions. You warrant that: The Personal Information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; and You will notify us immediately of any changes to the Personal Information by email to firstname.lastname@example.org. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorized to use. You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including any legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your shopping account and/or your Personal Information.
We reserve the right to: modify or withdraw, temporarily or permanently, this website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website; and/or change the Conditions from time to time, and your continued use of the website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions, you must immediately stop using the Website. To provide increased value to our Users, we may provide links to other websites or resources for you to access at your sole discretion. We are not responsible for the availability of such external sites or resources, for the privacy practices of such websites, the content of such websites, or the use to which others make of these websites or resources.
Imagine Living will take all reasonable precautions to keep the details of your order and payment secure but unless Imagine Living is obviously negligent, we will not be liable for unauthorized access to information supplied by you.
Product details and prices
Every effort is made to ensure that product details, descriptions and prices shown are accurate at the time you place your order. If an error is found, Imagine Living will inform you as soon as possible. If the price shown is incorrect, we will offer you the option of reconfirming your order at the correct price, canceling or changing the ordered product. All items are offered subject to availability. If on receipt of your order, the item(s) you have ordered become no longer available, Imagine Living will inform you as soon as possible, giving you the option to purchase an alternative product. If you decline this option, a refund will be made for the unavailable product.
We provided one or more photos or electronic images of our products, but each image should be viewed in conjunction with the descriptive text and will, of course, be limited by the screen settings of your own monitor screen. Variations in color of fabrics and furnishings will naturally occur and we do not guarantee that the final product will be the exact color of the swatch on www.imagine-living.com. Payment We ask for payment in advance of delivery. This can be by credit/debit card, via our checkout, or by cheque, postal order, or wire transfers accepted in £ (GBP) sterling only. If you are shopping from outside the United Kingdom, your card company will convert the transaction into your own currency. After you send your order you will receive an order pending confirmation by email, please print or keep this copy for your own records. This does not mean we have accepted your order. Once your credit has been approved, the receiving address has been verified, and the item has been located, your order will be accepted. All prices shown are in £ (GBP) sterling, and are inclusive of UK VAT at 20%. If you are not able to pay in Sterling, please contact us on email@example.com to discuss alternative payment options.
All credit card transactions are performed on our site by PayPal and WorldPay. WorldPay and PayPal provide secure online credit card and debit card payment solutions for thousands of online and mail order businesses globally. Imagine Living reserves the right to change or add additional credit card transaction agents at any point and time without sending notice the users. By completing your transaction, you agree to use the payment solution chosen on our checkout page.
Shipping, delivery and postage and packing
All relevant postage and packing, shipping or delivery charges may be included in the cost of your order. The goods you order will be delivered to the address you give when you place your order, and only to the street. If delivery cannot be made to your address for reasons under Imagine Living’s control, we will inform you as soon as possible. If you deliberately fail to take delivery of the order (otherwise than by reason of circumstances under the control of Imagine Living), without prejudice to any other right or remedy available to Imagine Living, Imagine Living will return this order directly to the factory of the supplier and will not issue a refund for the product. If within 14 business days of the return of the order to the factory you would like to accept the delivery, you will be responsible for paying any additional delivery charges up front and the goods will then be re-dispatched. Please inform Imagine Living as soon as possible if you need to change the delivery address or will not be available during a certain time to receive your order. We will do our best to accommodate the change in delivery. If we occur any additional delivery charges, you will be responsible for paying these charges in advance prior to the change being accepted by Imagine Living. If you fail to take delivery because you have cancelled your contract under the Distance Selling Regulations, Imagine Living shall refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the order, less any expenses incurred for failed delivery. Made to order furniture is non-refundable. Products from the following manufacturers, but not limited to these manufacturers, are made to order: Creazioni, Moda, Erba Italia, Europeo, AltaModa, and Softline. Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, Imagine Living will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, Imagine Living will inform you as soon as possible. If a carrier is used, upon receipt of your order you will be asked to sign for the items received in good condition. If you are unable to check the contents of the package at that moment in time please sign for the delivery as "UNCHECKED". Failure to do so may affect any claim for replacement or refund that you make thereafter. During the month of August, factory closings could delay delivery of your goods beyond the delivery time stated. Imagine Living will make best efforts to inform you of any delays.
Your Right of Cancellation (Distance Selling Regulations)
You have the right to cancel the contract at any time up to the end of 7 working days* after you receive your order (see below). To exercise your right of cancellation, you must give written notice to Imagine Living by letter, fax or email, giving details of the items ordered and (where appropriate) their delivery. Notification by phone is not sufficient. If you exercise your right of cancellation after the items have been delivered to you, you will be responsible for returning them to the manufacturer’s factory (address located on www.imagine-living.com) at your own cost. You must take reasonable care to ensure the items are not damaged in the meantime or in transit. If there is any damage to the items, you are responsible for the cost of repair or replacement of the item. Once you have notified Imagine Living that you are cancelling the contract, Imagine Living will refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the items less any direct costs incurred by Imagine Living for the return. If you do not return the goods as required, Imagine Living may charge you a sum not exceeding the direct costs of recovering the items. * Please note: This returns policy does not apply to non-returnable goods such as upholstered sofas, upholstered beds, wall systems and other customized or bespoke orders.
Returns and refunds
If we make a mistake with your order, or if the goods received are in some way faulty, simply return the item and we will replace it with the correct one. We will pay your return delivery costs. Out of stock items Sometimes, items are for a variety of reasons temporarily unavailable. We try to alert you to this fact on the website, but just occasionally, demand exceeds supply. If a product you have ordered is out of stock at our suppliers, we tell you about the problem, dispatch the rest of your order as normal, and place the out of stock item on back order. We try to estimate when new stocks will arrive and always give you the option of cancelling either the whole order or simply the out of stock item, if you would prefer not to wait. The out of stock item will be forwarded to you immediately it becomes available.
V.A.T. (Value Added Tax)
All prices on this website include a UK sales tax of 20% for V.A.T. This applies to UK customers and those resident within the European Union (EU). If you live outside the EU, this tax will be deducted from your order at checkout. Please note that to be eligible for a VAT reduction, we need to deliver to an address outside the EU. You are directly responsible for any import taxes applicable with delivery to any destination outside of the EU.
Limitation of Liability
Imagine Living total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the price paid for the goods. Nothing in these conditions excludes or limits the liability of Imagine Living for death or personal injury caused by the Supplier's negligence or fraudulent misrepresentation. If you are a trade customer Imagine Living shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.
These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
